Bojkott

Alulírottak úgy döntöttünk, hogy nem veszünk részt az október 6-7-re kiírt romániai népszavazáson és arra buzdítunk minden romániai állampolgárt, hogy bojkottálja azt. Azt valljuk, hogy egy szekuláris állam alkotmányát nem a hit- és a vallási előírások, hanem a mindenkire egyaránt érvényes, egyetemes emberi jogok szellemisége kell hogy jellemezze.

A problémafelvetést magát és annak közéleti bevezetését figyelemelterelő akciónak tekintjük az ország nagyon is valós politikai-gazdasági problémáiról. A referendum nem más, mint a román ortodox egyház és a kormánypártok kísérlete arra, hogy megváltoztassák a közbeszéd irányát, még akkor is, ha ezzel minden jogi és morális alapot nélkülöző módon egy egész társadalmi réteget tesznek közgyűlölet tárgyává.

Véleményünk szerint a referendumon való részvétel egy olyan politikai stratégia legitimálását eredményezné, amely kivitelezhető és bármikor alkalmazható módszernek tekinti az ellenségképzést és a társadalom polarizálását. Ennek támogatását már csak azért is problematikusnak tartjuk a kisebbségi pártok és egyházak részéről, mert ezzel szem elől tévesztik azt, hogy egy hasonló referendum adott esetben pontosan úgy ellenünk is fordítható.

Kiállunk embertársaink, az LMBTQ közösség tagjai mellett, akik semmilyen formában nem szolgáltak rá a minden korban csak a tudatlanságból, most pedig politikai érdekből is rájuk zúduló gyűlölethullámra. Határozott véleményünk, hogy az a kisebbség, amelyik saját kisebbségeit nem karolja fel és nem védi meg annak jogait, elveszti minden morális alapját saját kisebbségi jogainak követelésére.

Kiállunk a nem klasszikus családmodellben élők mellett is. Társadalmunk tetemes hányada él olyan közösségben, amelynek alapja nem egy férfi és egy nő házassága. A referendum kizárná a család meghatározásából nemcsak az egyszülős családokat, az össze nem házasodott szülős családokat, de az unokáikat nevelő nagyszülőket is, és még sorolhatnánk a példákat.

Azt sem téveszthetjük szem elől, hogy a család mint intézmény, nem kizárólag jogi kategória. Ez a nézetrendszer merőben leegyszerűsíti a kérdést és semmisnek veszi annak történeti, morális, tudományos és szociológiai dimenzióit.

Hasonlóan problémásnak tartjuk, hogy a referendum valójában jogi szempontból is értelmetlen, ugyanis a Polgári Törvénykönyv a házasságot jelenleg is csak egy férfi és egy nő között kötendő intézményként határozza meg. Attól sem kell tartania senkinek, hogy az EU rákényszeríthetné Romániát az azonos neműek házasságának intézményesítésére, ugyanis az EU ezt a kérdést minden állam szuverén hatáskörének tekinti.

Nem utolsó sorban úgy ítéljük meg, hogy a referendumot kezdeményező, keresztény fundamentalista Koalíció a családért egyesület befolyásának térhódítása rossz irányba viszi a közbeszédet, számos alapvető emberi jogot kérdőjelez meg, beleértve a nemi egyenjogúságot is és ezáltal aláássa az ország és társadalmunk demokratikus fejlődését. Emberi és kisebbségi jogokat pedig nem bocsátunk népszavazásra.

Már maga a referendum megtartása is, de az esetleges sikere még inkább hatalmas visszalépést jelentene Európa és a világ általános haladásához képest, amelyben a különböző, történelmileg is létezett és sok helyen még létező családformák harmonikusan megférnek egymás mellett.

Összegezve, a népszavazás:

1. Figyelemelterelő manőver az ország valódi problémáiról
2. Kisebbségellenes, és mint olyan, ránk is veszélyes precedenst teremt
3. Jogilag teljesen értelmetlen és hasztalan
4. Diszkriminálja mind az LMBTQ közösség tagjait, mind a sokféle más családban élőket
5. További emberjogi restrikciós népszavazásoknak nyithatja meg az utat
6. Szembemegy a jelenlegi európai és nemzetközi folyamatokkal

Mindezeket figyelembe véve a népszavazás bojkottjára szólítunk fel minden jóérzésű állampolgárt!

Subsemnații (semnatari ai prezentei petiții) am decis să nu participăm la referendumul din România, care va avea loc pe 6 și 7 octombrie și îi îndemnăm pe toți cetățenii români să îl boicoteze prin neprezentare. Susținem că într-un stat secular constituția nu poate fi fundamentată sau caracterizată prin aspecte legate de credință și religie, ci prin spiritul drepturilor universale ale omului, care se aplică în mod egal tuturor.

Vedem lansarea publică a acestei probleme din perspectiva prezentată ca pe o acțiune de distragere a atenției publice de la problemele politice și economice presante ale țării. Referendumul nu este altceva decât încercarea Bisericii Ortodoxe Române și a partidelor politice aflate la guvernare de a schimba direcția discuțiilor publice, mai mult chiar, transformând astfel, fără orice fel de fundament juridic sau moral, o întreagă categorie socială în ținta discursului public de discriminare și instigare la ură.

În opinia noastră, participarea la referendum conduce la legitimarea unei strategii politice care consideră incitarea publicului la ură și ostilitate, precum și polarizarea societății, drept metode fezabile și aplicabile în orice condiții. Susținerea unui asemenea act de către partidele și bisericile minoritare este problematică, deoarece acestea pierd din vedere faptul că un referendum similar poate fi tradus împotriva oricărui grup minoritar al acestei țări.

Suntem în totalitate solidari cu semenii noștri, membrii comunității LGBTQ, care fără orice vină devin, de la un moment la altul, ținta discriminării și a urii, din cauza ignoranței sau datorită unor interese politice. Suntem de părere că orice grup minoritar care nu se solidarizează și nu își protejează propriile comunități minoritare își pierde baza morală și legitimitatea în revendicarea propriilor drepturi ca minoritate.

Suntem, de asemenea, solidari cu persoanele care nu trăiesc în familii construite pe modelul clasic. O mare parte a societății noastre trăiește în comunități de diferite dimensiuni, care nu sunt bazate pe căsătoria dintre un bărbat și o femeie. Referendumul ar exclude din definiția familiei nu numai familiile monoparentale, familiile cu părinți necăsătoriți, ci și familiile compuse din bunici și nepoți și multe alte modele de familie.

Nu trebuie să pierdem din vedere nici faptul că familia, ca instituție, nu este doar o categorie legală. Această perspectivă prezentată de referendum simplifică semnificativ o problemă complexă și neglijează dimensiunile sale istorice, morale, științifice și sociologice.

De asemenea, considerăm problematic faptul că referendumul este, de fapt, lipsit de sens din punct de vedere juridic, deoarece Codul civil definește și în prezent căsătoria ca instituție care se stabilește numai între un bărbat și o femeie. Nimeni nu are motive să se teamă de puterea Uniunii Europene (UE) de a forța România să instituționalizeze căsătoria între persoane de același sex, deoarece UE consideră că luarea unei asemenea decizii stă doar în puterea suverană a fiecărui stat membru.

Nu în ultimul rând, credem că influența Coaliției pentru Familie, asociația creștină fundamentalistă care a inițiat acest referendum, este nocivă asupra discursului public, punând sub semnul întrebării o serie de drepturi fundamentale ale omului, inclusiv egalitatea de gen, subminând astfel dezvoltarea democratică a țării noastre și a societății. Drepturile omului și drepturile minorităților nu fac subiectul unui referendum.

Desfășurarea referendumului în sine, și mai ales potențialul lui succes, ar fi un uriaș regres față de progresul general al Europei și al lumii în abordarea acestui subiect, unde diferitele modele și forme de familii existente de-a lungul istoriei și cele existente acum pot fi în armonie una cu cealaltă.

În concluzie, referendumul este:

1. O manevră de distragere a atenției publice de la problemele reale ale țării;
2. Anti-minoritar și, ca atare, creează un precedent periculos pentru orice comunitate minoritară din România;
3. Este complet lipsit de sens și inutil din punct de vedere legal;
4. Îi discriminează atât pe membrii comunității LGBTQ, cât și pe persoanele care trăiesc în alte tipuri de familii;
5. Poate deschide calea către inițierea altor referendumuri care urmăresc restricționarea drepturilor omului;
6. Este în conflict cu valorile europene și internaționale.

Luând în considerare toate acestea, îi îndemnăm pe toți cetățenii să boicoteze referendumul!

We, the undersigned (signatories to this petition) who decided not to participate in the referendum held on October 6 and 7 in Romania, hereby urge all Romanian citizens to also boycott it by abstention. We argue that in a secular state the constitution cannot be grounded upon or characterized by aspects of faith and religion, but only by the principles of universal human rights, which apply equally to all.

We see the public debate about this issue from the presented perspective as an act meant to distract public attention from the country's pressing political and economic problems. The referendum is nothing but the attempt of the Romanian Orthodox Church and of the ruling political parties to change the direction of public discussion, and while doing that, lacking any legal or moral foundation, they willingly transform an entire social category into the target of hate speech and discrimination.

In our opinion, participation in this referendum leads to the legitimation of a political strategy that considers public incitement to hatred and hostility, as well as polarization of society, as feasible and applicable methods under all conditions. Supporting such an act by minority parties and representatives of minority faith communities and churches is problematic, because it seems to lose sight of the fact that a similar referendum can be turned against any minority group of this country.

We want to express solidarity with all members of the LGBTQ community who, without any of their own fault, often become the target of discrimination and hatred, mostly because of ignorance or just as now, due to some political interests. We believe that any minority group that does not solidarize with and does not protect its own minority communities loses its moral base and legitimacy in claiming its own rights as a minority.

We also want to show solidarity with people who do not live in families built on the classic model. Much of our society lives in communities of varying dimensions that are not based on the marriage between a man and a woman. The referendum wants to define family by excluding not only single-parent families, families with unmarried parents, but also families of grandparents and grandchildren and many other family patterns from this definition.

We must not lose sight of the fact that the family, as an institution, is not just a legal category.

Thus, the referendum oversimplifies a complex issue and neglects its historical, moral, scientific and sociological dimensions.

We also find it problematic that the referendum is, in fact, totally meaningless from the legal point of view, since the Romanian Civil Code clearly defines marriage as an institution based on the union between a man and a woman. Therefore, there are no reasons to fear the power of the European Union (EU) to force Romania to institutionalize same-sex marriage, moreover because the EU believes that taking such a decision lies only in the sovereign power of each Member State.

Last but not least, we believe that the spreading influence of the Coalition for Family, the fundamentalist Christian association that initiated this referendum, is detrimental to the public discourse, calling into question a number of fundamental human rights, such as gender equality, thus undermining the democratic development of our country and society.

Human rights and minority rights are never subject to a referendum.
In conclusion, the referendum is:

1. A feint, meant to distract public attention from the real problems of the country;
2. Against minority rights and, as such, creates a very dangerous precedent for any minority community in Romania;
3. Completely meaningless and useless from the legal point of view;
4. Discriminating against both the members of the LGBTQ community and the people living in alternative family structures;
5. Paving the way to other referenda or political action aimed at further restricting human rights;
6. In conflict with European and international values.

Considering all this, we urge all citizens to boycott the referendum!
